These Terms and Conditions ("Terms") govern your use of aerlogs ("the Service"), a changelog platform operated by Enactory Ltd (Company Number: 15664650) ("we," "our," "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using aerlogs, you represent that:

• You are of legal age to form a binding contract
• You have the authority to bind your organization (if applicable)
• All information you provide is accurate and current

4.1 Permitted Use

You may use the Service to:

• Publish product updates and changelogs
• Communicate with your customers
• Embed changelogs on your website
• Use the API for legitimate integrations

4.2 Prohibited Activities

You may not:

• Violate laws or regulations
• Infringe intellectual property rights
• Publish harmful, offensive, or illegal content
• Spam or send unsolicited emails
• Reverse engineer or attempt to access source code
• Overload or disrupt the Service (e.g., DDoS attacks)

5. Intellectual Property

5.1 Your Content

You retain all rights to the Content you create using the Service. By publishing Content, you grant us a worldwide, royalty-free license to host, store, and display your Content for the purpose of operating the Service.

5.2 Our Intellectual Property

The aerlogs platform (code, design, branding, documentation) is owned by Enactory Ltd and protected by copyright, trademark, and other laws. You may not copy or redistribute our software without permission.

6. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to our Privacy Policy.

For business customers who collect email subscribers via aerlogs, we act as a data processor. You are the data controller and must comply with GDPR and other applicable laws.

7. Termination

7.1 Termination by You

You may cancel your subscription at any time via your account settings. Access continues until the end of your billing period (no refunds for unused time).

7.2 Data Retention After Termination

• Soft deletion: Account data retained for 90 days (restore available)
• Permanent deletion: After 90 days, all data is permanently deleted
• Billing records: Retained for 7 years (legal requirement)

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy.

You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Third-party actions (integrations, custom domains)

Our total liability is limited to the amount you paid in the 12 months preceding the claim (or £100 if greater).

9.1 Exceptions

This limitation does not apply to:

• Fraud or fraudulent misrepresentation
• Death or personal injury caused by our negligence
• Other liabilities that cannot be excluded under UK law

10. Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
